I. Definitions

The Terms and Conditions define the conditions for the provision of electronic services on the website.

The terms used in the Terms and Conditions are defined as follows:

  • Office (Operator) – Biuro Turystyczno Pielgrzymkowe Frater Adam Zielinski, with its registered office at 18 Dworcowa, 85-010 Bydgoszcz, TAX Identification Number 967 035 11 14, REGON 093166900 e-mail: biuro@frater.pl, telephone number: +48 783 800 300.
  • Tourism Event – service as defined by the Polish Act of November 24, 2017 on tourist events.
  • General Terms and Conditions of Participation – terms and conditions of participation that constitute the integral part of the agreement.
  • Payment –  the payment for the service selected by the User.
  • Online Payment – payment made electronically.
  • The Terms and Conditions – this document.
  • Reservation – registration for participation in the tourism event.
  • Service – the website of the tour operator.
  • User – website user.
  • Traveler (Participant) – a participant of the tourism event.

II. Office Operational Status

    1. The office is a tour operator as defined by the Polish Act of November 24, 2017 on tourist events and related tourism services.
    2. The office has financial security required by law in the form of insurance guarantee granted by Compensa TU S.A. Vienna Insurance Group.
    3. The office is registered in the Register of Tour Operators and Travel Agents maintained by the Marshal of Kujawsko-Pomorskie Voivodship under number 16.

III. General Provisions

  1. Each User of the service is obliged to comply with the Terms and Conditions.
  2. It is prohibited to:
    • upload the content that violates the law,
    • intefere with the functioning of the Service,
    • breach the data security.

IV. Technical Requirements for the Use of the Service

  1. Using the Service requires:
    • a device with internet access,
    • updated browser.
  2. The Office is not liable for any issues arising from the User’s device or software.
  3. The Service uses cookies in accordance with its Privacy Policy.

V. Scope of Services

  1. The Service enables the User to:
    a) familiarize themselves with the offer of Tourism Events,
    b) make a reservation,
    c) contact the Office,
    d) conclude an agreement on participation in a Tourism Event,
    e) access documents including General Terms and Conditions of Participation and information required by law.
  2. The Service is available 24 hours a day, 7 days a week, subject to technical maintenance.

VI. Conclusion of the Agreement

  1. Information published in the Service does not constitute an offer within the meaning of the Civil Code.
  2. The reservation constitutes an offer to conclude an agreement.
  3. The agreement is concluded after:
    • confirmation of availability,
    • acceptance of the terms and conditions by the User,
    • making the required payment.
  4. The agreement can be concluded:
    • online,
    • by e-mail,
    • by telephone,
    • at the office location.

VII. Payment

  1. Available payment methods:
    • bank transfer,
    • online payment,
    • payment at the office location.
  2. The User is obliged to make the payment in accordance with the deadlines specified in General Terms and Conditions Participation.
  3. The prices include VAT.

VIII. Cancellation of Withdrawal

  1. Cancellation of the agreement before its conclusion is cost-free. 
  2. Conditions of the cancellation after conclusion of the agreement are specified in General Terms and Conditions of Participation.
  3. According to Article 38 of the Consumer Rights Act, the act to withdraw from a distance agreement does not apply to travel services.

IX. Copyright

The content published on the Service is protected by copyright and may not be used without permission of the Office.

X. Digital Services

  1. The Office is responsible for ensuring the compliance of digital services with legal regulations.
  2. The Office may introduce changes in the Service in the event of:
    • development of the services,
    • changes in the law.

XI. Contact

  1. The User is obliged to provide accurate contact information.
  2. The Office may contact the User:
    • by phone,
    • by mail.

XII. Responsibility of the User

  1. The User must be at least 18 years old and have full legal capacity.
  2. The User is responsible for the accuracy of the personal data provided.

XIII. Limitation of Liability

  1. The Office is not liable for:
    • Internet downtime,
    • incorrect data provided by the User,
    • the User’s failure to meet the terms and conditions of participation in the Tourism Event.
  2. The above limitations do not apply insofar as the liability results from mandatory legal provisions.

XIV. Personal Data

The rules of personal data processing are defined in the Privacy Policy.

XV. Complaints

  1. Complaints about the functioning of the Service can be sent:
    • by e-mail: biuro@frater.pl,
    • in writing to the address: Dworcowa 18, 85-010 Bydgoszcz, Poland.
  2. Complaints are processed within 30 days.
  3. Complaints about the organization of the Tourism Event are to be submitted in accordance with the provisions of the General Terms and Conditions of Participation.

XVI. Out-of-court Dispute Resolutions

  1. The User and consumer has the right to use the out-of-court dispute resolutions.
  2. In particular, the User may use the ODR platform: https://ec.europa.eu/consumers/odr
  3. Detailed information can be obtained from the appropriate consumer protection authorities.

XVII. Final Provisions

  1. The Office may change the Terms and Conditions in the event of:
    • the change of legal regulations,
    • the development of services.
  2. The Users will be informed about the changes.
  3. By continuing to use the Service, the User agrees to changes.
